1.Introduction

  • The following Terms and Conditions shall apply to parties living inside and outside of Japan using or purchasing items from JAPANSQUARE.com (hereinafter “the Site”), a website administered by Navibird, Inc. (hereinafter "the Company"; a Japanese company headquartered, 5-12, Kyutaromachi 2-Chome, Chuo-ku, Osaka 541-0056, JAPAN). While using or purchasing items from the Site you are considered to be in agreement to the terms of this document, so you should understand and agree to the following Terms and Conditions before using the Site.

2.How to Order and Delivery

  • When placing an order for the first time, please agree to the contents of these Terms & Conditions and accurately provide your name and address information beforehand. It is required of the customer wishing to register to correctly register the correct information in order for the Company to issue a member ID and password (member registration).Please consult with the “Countries and Regions We Ship To” and “Shipping and Handling Charges” pages for more information regarding service in your area.
  • Please take care to prevent discovery and misuse of your member ID and password by a third party. You are considered to have agreed to bear responsibility for all actions taken using your ID and password.
    If you would like to have the order re-shipped, then you should pay the actual, full price of the shipping costs, etc.
  • • The maximum purchase limit per order is 3,000,000 yen per order. This limit or 3,000,000 yen only includes the total item amount and does not include shipping & handling fees and special shipping fees.
  • The contract between the customer and the Company shall be established at the time that the Company ships the relevant item(s) to the customer. The sending of an Order Confirmation email by the Company is for the purpose of confirming the contents of your application to enter into a contract with the Company, and does not mean that the Company has approved your application to enter into said contract.

    Even after sending the Order Confirmation email, due to there being a difference between the stock status displayed on Company's site and actual stock, there may be cases where there is a stock shortage of one or all items. Furthermore, the Company's stock status differs from the suppliers'. Please kindly understand that there are also cases where the same item is in stock at a supplier and out of stock at the Company.
  • In the event that one or more items ordered as part of an order are out of stock, the equivalent cost of the out-of-stock items will be deducted from the settlement amount and the order will be shipped without prior notification. Additionally, even if the item comes into stock after the order has shipped, the Company is unable to ship the item as a supplement to your previous order. Please make a new order for the item.
  • Order contents (such as size, color, or quantity) and the shipping address information cannot be changed once the order has been placed. Orders cannot be cancelled or changed in any way once they have been submitted.
  • Although the Company strives to ship your order within 9 days from the day it was placed, depending on the contents of the order, the condition of stocks, and the volume of orders, there may be instances where shipment of the order is delayed. Also, items from the Site may take additional time for production.
  • You should investigate the rules and regulations regarding importing into your country, including goods restricted for import, before placing an order. In the unlikely event that an ordered item is not allowed for import into your country or is subject to tax due to its high value, the Company cannot accept responsibility for the item. The Company cannot provide you any refunds or exchanges for the item or cost of delivery.
  • The Company reserves the right to combine multiple orders from the same customer, and ship them together as one unit. Even in the event that this results in shipping and handling fees being levied multiple times, the Company will not refund them.
  • Orders to countries and regions other than Hong Kong & Macau will be sent by Express Mail Service (EMS). Orders to Hong Kong & Macau will generally be sent by the international courier DHL or an Overseas Courier Service (OCS). However, depending on the contents of the order EMS may also be used. Deliveries within Japan will be sent by Yamato Transport's express home delivery service. No matter the country or region, you may not choose the shipping service.

3.Shipping and Handling Charges

  • Shipping and handling charges are set based on the total amount of ordered merchandise and those charges include the Express Mail Service (EMS) or international courier postage, domestic courier service charge etc., and insurance fees, etc. They should be paid together with the total amount of the ordered merchandise.
  • Certain items are charged "extra charges for special shipping". Each item is charged a "extra charge for a special shipping" in addition to the shipping charge and the purchase amount. (For shipment overseas (outside of Japan))
  • In the event that you refuse to accept the delivery of an order, or if an order is returned to the Company after the retention period at the post office has passed after failed delivery attempts, the cost of returning the item to the Company will be deducted from the cost of the items when making the refund, and will not be returned to you. Further, if the cost of returning the item to the Company is more than the value of the items, you must pay that difference to the Company.

4.Payment

  • The amount charged to you will be the total sum of the merchandise plus the shipping & handling fee and special shipping fee. (For shipment overseas (outside of Japan))
  • The amount charged will be the of the total sum of the merchandise plus the shipping & handling fee and consumption tax. (For shipment within Japan)
  • The Company accepts payment by credit card, PRC RMB, PayPal, and Alipay. For more details regarding payment, please contact directly your credit card company, your debit card company, PayPal, or Alipay.
  • In the event of a credit card order, please use a credit card that is in your own name. If you use a credit card that is not in your name, the Company may refuse your order(s) without prior notice.
  • When you place an order, you may use PRC RMB cards issued by banks only on the Chinese mainland.
  • Credit card, PayPal, and Alipay settlements will be made in Japanese Yen, and for PRC RMB cards, settlement will be made in Chinese Yuan.

5.Customs Duties and Export Certificates

  • Orders may be subject to import tax, value tax, customs handling fees, and/or delivery fees in some countries or regions. In this case, you (or the recipient if the merchandise is shipped to someone other than you) should be responsible for the payment of any such taxes or fees.
  • In the event that the delivery of an order is delayed due to complications or processing at customs, the Company bears no responsibility for this situation.
  • We do not issue certificates of origin, export visas for export verification, etc for delivered items.

6.Returns and Exchanges

  • For exchanges and returns, please be sure to contact JAPANSQUARE via email or fax within 14 days of item receipt regarding the details of the return item. After contacting us, please return only the items we approve (within 7 days of approval). We will not accept a return if you contact us after 14 days or not sent the item back with no contact at all.

  • 1.In the case of "JAPANSQUARE at Fault"
    • (1) The merchandise is different from what you ordered (wrong shipment).
    • (2) The merchandise is defective.
    • (3) The merchandise is damaged.

    The Company will reimburse you for shipping costs incurred. (In the event of a return of set merchandise (ex. 2-Piece Set, or others sets), please include all items in the set in the condition that it was delivered in when making the return. If even 1 item is missing from the set (or, an included item or accessory), the Company will not be able to process your return.)

  • 2.In the case of “At the Convenience of the Customer”

    Should an item not be to your liking (because you wish to change the size, color, pattern or change from a plate to cup etc.), the return shipping shall be paid by the customer. Also, we will not be able to accept your return in the following cases.

    • You did not inform us about the return/exchange within 14 days of receiving the item
    • Food item
    • Items that have been used
    • Order-made items((items manufacture after being order,  e.g. a hanko)
    • Engraved items
    • Cosmetics,hygiene products where the package has been opened
    • Items without a case or packaging (bag, etc)
    • Items that have been altered and cleaned
    • Items that you have soiled or damaged (incl. cosmetics, fragrances, odors)
    • Items with the tag removed
    • Items that have been warped by test trying on
    • SALE items, outlet items, items marked with “no return/exchange” on the item page

  • 3.In the case of "JAPANSQUARE at Fault"
    • (1) The merchandise is different from what you ordered (wrong shipment).
    • (2) The merchandise is defective.
    • (3) The merchandise is damaged.

    The Company will reimburse you for shipping costs incurred. Please inform the Company in advance if you wish to make an exchange. If the item(s) to be exchanged are out of stock or have been discontinued, you will be given a full refund for the merchandise.

  • 4.In the case of “At the Convenience of the Customer”, exchanges are not accepted.
    • If you are not satisfied with the items (because they do not fit or you do not like the color or print), the return will not be accepted. If you wish to exchange an item, we will send your new item after we have received your return.
    • Merchandise must be returned, with a “Returns and Exchanges” form, by Express Mail Service (EMS) or by airmail. Please do not send your return by surface mail, economy air (SAL), DHL, FedEx, UPS, or any other private international mail carrier. If the return is made through any method other than EMS or airmail it will not be accepted, and you will not receive a refund on the merchandise.
    • For customers living within Japan, please send back via Yamato Transport.
    • In the case of “Circumstances Arising with the Company”, you must pay in advance for shipping charges. Collect/Cash on Delivery (COD) shipments will not be accepted.
    • As soon as we confirm the arrival of a return item at the Company's address, we will send the exchange item or provide a refund. Should the returned item package not also include an Exchanges & Returns form, processing may be delayed.
    • There are 2 methods of refund (merchandise and shipping costs) for the customer to choose from.
      • (1) The amount of the refund will be credited to the customer’s account in the form of JAPANSQUARE shopping points (JPY 1 = 1 point).
        There is no loss due to fluctuating exchange rates, and the refund can be processed quickly. (Please note that depending on campaign rules, there are situations where points are not available for use.)
      • (2) Refund through the credit card, PRC RMB, PayPal, or Alipay account that was used to purchase the merchandise.
        The merchandise or shipping refund will be made through the credit card or debit card company, or PayPal or Alipay account that was used to purchase the merchandise. In the event of a refund through a credit card, PayPal, or Alipay, exchange rates applied to the amount billed for the merchandise and shipping and handling charges may differ from those at refund. Thus, there may be differences in the total amount refunded due to exchange rate differences. Also, please note that in the event of a credit card refund, depending on the different monthly deadlines of processing and pay dates, it may take as long as 2 months for the refund to process; for PayPal and Alipay, it make take from a few days, to the maximum of 10 days for the refund to finish processing. In the event that the amount of a refund exceeds the amount paid at the time of purchase, as the Company is unable to process that refund through the method used at the time of purchase, the Company will convert the difference into JAPANSQUARE points and refund the remainder into your account.

7.Others

  • You should immediately log into the Site and amend your personal details if any changes in the information you have registered with the Company, such as name and address details, have occurred.
  • The Company has the right to cancel your registration at any time if you perform any of the following. If your account is deleted, your points are considered to become completely invalid and will not be compensated for.
    • (1)You do not comply with the Terms and Conditions.
    • (2)You have been a nuisance or caused interference or damage to other customers or the Company, or committed any fraudulent acts.
    • (3)You have not placed an order with the Company for over one year.
    • (4)Any other circumstances in which the Company determines that you should be disqualified.
  • Any other circumstances in which the Company determines that you should be disqualified.
  • The Company may suspend this mail-order service if an unavoidable situation arises. In this case, the purchase contract already in effect will continue to apply under these Terms and Conditions.
  • With respect to use of the Site, Japanese law is considered to apply in full, and any problems that may arise between you and the Company will be subject to the exclusive jurisdiction of the Osaka Regional Count in Japan under relevant Japanese law.
  • The Company will not use the information you registered pursuant to these Terms and Conditions for any purposes other than the sale of its merchandise and provision of merchandise information via website and international mail. If you request deletion or change of any part of such information, the Company will immediately comply with the request.
  • The Company reserves the right to amend these Terms and Conditions as necessary. Even if a part of these Terms and Conditions is deemed to be improper or invalid, these Terms and Conditions are severable, and there will be no effect on the efficacy of other parts of these Terms and Conditions.
